Klauzula informacyjna o przetwarzaniu danych osobowych

3. Cele przetwarzania danych osobowych

Jeżeli jako osoba fizyczna jest Pani/Pan naszym klientem, kontrahentem lub kierujemy do Pani/Pana zapytanie ofertowe:

• kierowanie zapytań ofertowych lub udzielenie odpowiedzi na kierowaną do nas korespondencję – podstawa przetwarzania danych to realizacja naszych prawnie uzasadnionych interesów Administratora w postaci nawiązywania współpracy lub komunikacji z nadawcami i odbiorcami korespondencji (art. 6 ust. 1 lit. f) RODO);
• wykonanie umowy lub świadczenie związanej z tą umową usługi – podstawa przetwarzania danych to wykonanie umowy lub podjęcie niezbędnych działań na Pani/Pana żądanie przed jej zawarciem (art. 6 ust. 1 lit. b) RODO);
• obsługa zgłoszonej przez Panią/Pana reklamacji – podstawą prawną przetwarzania danych osobowych jest prawnie uzasadniony interes Administratora, polegający na rozpatrzeniu reklamacji (art. 6 ust. 1 lit. f) RODO).

Jeżeli jest Pani/Pan pracownikiem lub osobą reprezentującą naszego kontrahenta lub podmiot, do którego kierujemy zapytanie ofertowe:

• realizacja umowy lub podjęcie działań zmierzających do realizacji umowy – podstawą prawną przetwarzania danych osobowych jest prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f) RODO).

W takim przypadku dane możemy otrzymać bezpośrednio od Pani/Pana lub od podmiotu, który Pani/Pan reprezentuje i mogą to być dane Panią/Pana identyfikujące, kontaktowe, a także dotyczące wykonywanej umowy.

Niezależnie od powyższego możemy przetwarzać dane w celu:

• dochodzenia ewentualnych roszczeń lub obrony przed ewentualnymi roszczeniami – podstawą prawną przetwarzania danych osobowych jest prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit. f) RODO);
• realizacji obowiązków wynikających z przepisów prawa (np. podatkowych lub księgowych) – podstawą prawną będzie wypełnienie obowiązków prawnych ciążących na Administratorze (art. 6 ust. 1 lit. c) RODO).

4. Odbiorcami Pani/Pana danych osobowych mogą być podmioty współpracujące na podstawie umów cywilnoprawnych z Nałęczów Zdrój Sp. z o.o., jeżeli wynika to z zakresu ich kompetencji, w szczególności świadczące usługi w zakresie serwisu i utrzymania systemów IT oraz oprogramowania. Pani/Pana dane mogą być także przekazane firmom kurierskim lub operatorom pocztowym w celu realizacji zlecenia wysyłki lub odbioru przesyłek. Dane osobowe mogą być udostępnione podmiotom upoważnionym na podstawie przepisów powszechnie obowiązującego prawa, w szczególności instytucjom uprawnionym do kontroli działalności Administratora
5. Pani/Pana dane osobowe będą przetwarzane nie dłużej, niż jest to konieczne do udzielenia Pani/Panu odpowiedzi, osiągnięcia celu przetwarzania lub wykonania umowy albo do momentu wyrażenia sprzeciwu (w przypadku przetwarzania na podstawie prawnie uzasadnionego interesu Administratora).

Dane mogą być także przetwarzane do czasu przedawnienia ewentualnych roszczeń lub przez okres wynikający z odpowiednich przepisów prawa (np. podatkowych).

6. Przysługują Pani/Panu następujące prawa związane z przetwarzaniem danych osobowych:
   • prawo żądania dostępu do danych osobowych;
   • prawo żądania sprostowania danych osobowych;
   • prawo żądania usunięcia danych osobowych;
   • prawo żądania ograniczenia przetwarzania danych osobowych;
   • prawo do wniesienia sprzeciwu wobec przetwarzania danych ze względu na szczególną sytuację (jeśli przetwarzamy Państwa dane na podstawie uzasadnionego interesu Administratora);
   • prawo do wniesienia sprzeciwu wobec przetwarzania danych do celów marketingowych i natychmiastowego zaprzestania przetwarzania danych w tych celach;
7. W zakresie realizacji powyższych praw, można kontaktować z Administratorem poprzez adres poczty elektronicznej: rodo@cisowianka.pl
8. Przysługuje Pani/Panu prawo do wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych, ul.  Stanisława Moniuszki 1A, 00-014 Warszawa.
9. Podanie danych jest dobrowolne, jednak jest warunkiem koniecznym do odpowiedzi na Pani/Pana korespondencję albo wykonania umowy lub świadczenia związanej z tą umową usługi.

3. Purposes of personal data processing

If you are a natural person who is our customer or contractor, or if we send you a request for proposal:

• sending requests for quotations or responding to correspondence addressed to us – the basis for data processing is the pursuit of our legitimate interests as the Controller in the form of establishing cooperation or communication with senders and recipients of correspondence (Article 6(1)(f) of the GDPR);
• performance of a contract or provision of a service related to that contract – the basis for data processing is the performance of a contract or taking the necessary steps at your request prior to entering into a contract (Article 6(1)(b) of the GDPR);;
• handling of your complaint – the legal basis for the processing of personal data is the legitimate interest of the Controller, consisting in the examination of the complaint (Article 6(1)(f) of the GDPR).

If you are an employee or a representative of our contractor or an entity to which we send a request for proposal:

• performance of a contract or taking steps to enter into a contract – the legal basis for the processing of personal data is the legitimate interest of the Controller (Article 6(1)(f) of the GDPR).

In this case, we can receive data directly from you or from the entity that you represent, and it may be your identification data, contact details, as well as data concerning the contract being performed.

Notwithstanding the above, we may process data for the following purposes:

• pursuing possible claims or defending against possible claims – the legal basis for the processing of personal data is the legitimate interest of the Controller (Article 6(1)(f) of the GDPR);
• fulfilling obligations arising from legal provisions (e.g. tax or accounting) – the legal basis will be the fulfilment of legal obligations incumbent on the Controller (Article 6(1)(c) of the GDPR).

4. The recipients of your personal data may be entities cooperating with Nałęczów Zdrój Sp. z o.o. on the basis of civil law contracts, if this results from the scope of their competences, in particular those providing services in the field of IT systems and software maintenance and servicing. Your data may also be transferred to courier companies or postal operators for the purpose of shipping or receiving parcels. Personal data may be made available to entities authorised under generally applicable law, in particular to institutions authorised to control the activities of the Controller.
5. Your personal data will be processed for no longer than is necessary to respond to you, achieve the purpose of the processing or perform the contract, or until you object (in the case of processing based on the Controller’s legitimate interest).

The data may also be processed until the expiry of any claims or for the period resulting from relevant legal provisions (e.g. tax regulations).

6. You have the following rights in relation to the processing of your personal data:
   • the right to request access to your personal data;
   • the right to request the rectification of your personal data;
   • the right to request the erasure of your personal data;
   • the right to request the restriction of the processing of your personal data;
   • 5the right to object to the processing of data due to a specific situation (if we process your data on the basis of the legitimate interest of the Controller);
   • the right to object to the processing of data for marketing purposes and to immediately cease processing data for these purposes;

9. Providing data is voluntary, however, it is necessary to reply to your correspondence, to perform a contract, or to provide a service related to this contract.
